2007/10/03 The Election in Saint-Constant is Nullified: A Victory for Louis Demers
Mr. Justice Gilles Mercure of the Québec Superior Court has nullified the election of the mayor and five councillors in the City of Saint-Constant due to electoral fraud. Given the urgency of the matter, his judgment is executory notwithstanding appeal.
According to Me Louis Demers, the lawyer representing the plaintiffs, “This is a first in Québec, given the number of elected officials involved and the extent of the deficit.” The nullification is based on the fact that election expenses exceeded the permitted maximum by 42%.
Consequently, there is no longer a quorum at the Saint-Constant City Hall and the city is under the tutelage of the Minister of Municipal Affairs.
